How to Transfer an Off-Plan Property in Dubai Before Handover

Direct answer

Can you transfer a Dubai off-plan property before handover?

Yes, if the unit and contract are eligible: confirm the current provisional/Oqood registration, satisfy the developer's written resale conditions, obtain its NOC and register the disposition through the applicable DLD process. A private assignment alone is not enough—Dubai Law No. 13 of 2008 says off-plan dispositions that are not entered in the Interim Property Register are void.

Before completion, the seller normally transfers registered contractual rights in an off-plan unit; final title registration follows the completed-project process. The exact workflow depends on the SPA, payment status, developer, mortgage or finance position and current DLD channel.

There is no safe universal answer such as “pay 30% and you can sell.” Ask the developer for a dated statement of the exact resale threshold, NOC conditions, outstanding balance and charges for this unit before signing a resale agreement or taking buyer funds.

First decide whether the off-plan contract is transferable

DLD's FAQ states that resale is possible after obtaining a No Objection Certificate from the developer. The same FAQ describes initial registration as the record for off-plan sale contracts and other legal actions before the final property register.

Use DLD's Project Status Enquiry to match the exact project, developer, completion and escrow details. A project or community name in an advertisement is not enough to identify the legal record.

Article 3 of Law No. 13 of 2008 requires off-plan dispositions to be entered in the Interim Property Register and makes an unregistered sale or other disposition void. Articles 6 and 8 allow registered off-plan units to be disposed of and describe movement to the Property Register after completion and fulfillment of contractual obligations.

Documents commonly required

DLD's initial-sale service explains that off-plan units are registered in the provisional register through Oqood and identifies the SPA and party identity documents as core inputs. A secondary resale can require additional developer and transaction documents, so obtain the exact current checklist for the applicable channel.

Official source: Request to register the initial sale
  • Signed SPA and any valid amendments or assignment provisions.
  • Oqood/provisional-registration evidence for the exact unit.
  • Seller and buyer Emirates ID or passport evidence as applicable.
  • Current developer account statement and payment receipts.
  • Developer NOC and its unit-specific conditions.
  • Signed resale/assignment agreement prepared for the applicable process.
  • Broker, power-of-attorney or corporate-authority documents where relevant.
  • Mortgage or finance-provider NOC, settlement and release evidence where applicable.
  • Registration, fee and final reconciliation receipts.

Do not quote one universal transfer cost

Build a written, unit-specific cost sheet before agreeing the net proceeds

Article 7 of Law No. 13 of 2008 says a master developer or sub-developer may collect only administrative costs approved by DLD for an off-plan sale, resale or other disposition. Ask for the current itemized quote rather than relying on a percentage copied from another project.

After project completion

Law No. 13 of 2008 states that completed projects are registered in the Property Register after the completion certificate and that units are registered in purchasers' names when their contractual obligations are fulfilled. DLD's separate procedure completes eligible initial registration data and issues the title deed through Oqood. Check which stage the exact unit has reached before choosing an off-plan assignment or completed-property sale process.

Frequently asked questions

Can I sell an off-plan property before handover in Dubai?

Yes, when the registered unit and contract are eligible, the developer's written conditions are satisfied, its NOC is obtained and the disposition is registered through the applicable DLD process.

How much must I pay before I can resell?

There is no reliable universal percentage. The threshold can depend on the SPA, developer, project and payment status. Obtain the requirement for the exact unit in writing before marketing it as transferable.

Do I need a developer NOC?

DLD's FAQ says resale is possible after obtaining a No Objection Certificate from the developer. Confirm the exact unit-specific conditions and validity period directly with that developer.

Is signing an assignment contract enough?

No. Article 3 of Law No. 13 of 2008 says off-plan dispositions must be entered in the Interim Property Register and an unregistered disposition is void.

What is Oqood?

It is the DLD system used for provisional registration of off-plan units and related procedures before final title registration. Match the Oqood/provisional record to the SPA, parties and exact unit.

Official source: Request to register the initial sale
How much is the transfer fee?

Do not rely on one quoted percentage. Request a current written cost sheet covering the applicable DLD registration, developer administration/NOC, trustee or service channel, brokerage/legal work, finance release and installment reconciliation.
